Terms of Service

1. The Service

WhatsWinning.AI is a trend-discovery and research tool that surfaces and ranks publicly available short-form video content by view momentum over different time windows. We do not host the videos; every item links back to the original post and creator. Rankings, metrics, and transcripts are provided for informational and research purposes only, may be inaccurate or incomplete, and are not a guarantee of any result, income, or outcome. We are not affiliated with, endorsed by, or sponsored by Instagram, Facebook, Meta, or any creator, brand, or product shown through the Service.

2. Eligibility & Accounts

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Any paid subscription must be purchased and paid for by a person who is at least 18 years old (or by a parent or guardian on a minor’s behalf), using a payment method they are authorized to use.

Accounts are created and verified with a mobile phone number using a one-time passcode (OTP). You are responsible for keeping access to that phone number secure and for all activity under your account. One account is permitted per phone number.

3. Subscriptions, Billing & Auto-Renewal

• The Service is offered on paid monthly subscription tiers. Current prices are shown at checkout and may change on renewal with notice.
• Auto-renewal: your subscription automatically renews each month and your payment method is charged the then-current price until you cancel. By subscribing, you authorize these recurring charges.
• Plan changes: upgrades take effect immediately (with any price difference prorated onto your next invoice); downgrades take effect at the end of your current billing period.
• Payments are processed by Stripe. We do not store your full card details.
• You can cancel auto-renewal at any time from your account. See Section 5.

4. Promotional & Partner Codes

Promotional or discount codes (including first-month discounts and partner codes such as CREATORLAB) are limited to first-time subscribers, one redemption per person/phone number, and may not be combined, transferred, resold, or reused across multiple accounts. We may void discounts and suspend accounts that abuse promotional offers.

5. Cancellation & No Refunds

You may cancel auto-renewal at any time. When you cancel, your subscription remains active through the end of the current paid billing period and then ends; you will continue to have access until that date.

All fees are non-refundable. Except where required by applicable law, we do not provide refunds or credits for partial billing periods, unused time, or already-paid months, and cancelling does not retroactively refund prior charges.

6. Acceptable Use

You agree not to:

• scrape, crawl, copy, resell, or redistribute the Service’s data, rankings, or transcripts;
• share, resell, or provide access to your account, or exceed the one-account-per-person limit;
• attempt to bypass the paywall or access features not included in your plan;
• reverse-engineer, disrupt, or place unreasonable load on the Service; or
• use the Service to violate any law or the terms of any third-party platform.

We may suspend or terminate accounts that violate these Terms.

7. Third-Party Content & Intellectual Property

Videos, thumbnails, captions, names, and marks displayed through the Service are the property of their respective owners and are shown for reference and commentary, with links back to the source. We do not claim ownership of that third-party content. The Service’s own software, design, branding, and the compiled rankings and analytics are our intellectual property and may not be used without permission.

8. Copyright & DMCA Notices

We respect intellectual property rights. If you are a rights holder and believe that content displayed through the Service infringes your copyright, send a notice to admin@whatswinning.ai that includes: (a) identification of the copyrighted work; (b) the URL or location of the material on the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and that you are the rights holder or authorized to act on their behalf. We will respond to valid notices as required by applicable copyright law.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that metrics, rankings, or transcripts are accurate, current, or complete, that the Service will be uninterrupted or error-free, or that use of the Service will produce any particular result or income.

10. Limitation of Liability

To the maximum extent permitted by law, Sol Studios LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or USD $100.

11. Indemnification

You agree to indemnify and hold harmless Sol Studios LLC and its owners from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated date; your continued use after changes take effect constitutes acceptance.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. You agree that any dispute relating to the Service will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
